Late Stages of Death Penalty Case

Because of the seriousness of the penalty, all capital punishment cases undergo a mandatory and automatic appeals process. It is during appeals that the defense and prosecution present their respective sides of the case. An appellate court will then review their statements. The defense will do everything to prove that his being convicted and/or sentenced was somehow unlawful or unfair.

Appeals are typically based upon legal mistakes, like inappropriate jury directions or excluded piece of evidence. An appellate judge is the one to choose if the conviction must apply. Capital punishment cases will probably undergo several appeals and be completed in a number of years.

The final stage of a death penalty case is the execution of the convicted inmate. There is a death warrant released that indicates the exact time and date of the execution. In most cases, the inmate is placed into a cell close to the execution chamber the night before his execution. He is subsequently put on suicide watch during the hours prior to the execution. The authority will give the inmate the chance to say his final words and a final meal. Depending upon the state, he will be executed by firing squad, hanging, gas chamber, electrocution or lethal injection.
